The High Court in Malindi on Wednesday upheld the election of Kilifi Governor Amason Kingi citing insufficient evidence to invalidate the election.
While delivering his ruling, Justice Weldon Korir ordered the petitioner, former Labour Cabinet Secretary Kazungu Kambi to pay Ksh 4 million as costs for the case.
The former CS will pay Kingi Ksh 2.2 million and Ksh 1.8 million to the Independent Electoral and Boundaries Commission (IEBC).
Kambi had moved to court seeking orders to invalidate Kingi’s election on grounds that the August 8 election was marred by massive irregularities and illegalities.
Key among the issues raised by Kazungu was the suspension of elections at the county tallying center in Pwani University on August 9 2017.
The county returning officer admitted she suspended the election because there were security threats.
Justice Korir said despite the hitches, tallying was done at the polling station adding that whatever happened did not have significant effects on the elections.
He also said the irregularities reported by Kazungu did not affect the election results in Kilifi County.
Both Kilifi Governor and the petitioner Kazungu Kambi were absent when the judgment was delivered in court.
